The following are the Terms and Conditions for orders placed with FGE Mobile Phones & Accessories Limited (hereafter referred to as FGE). By accessing this website and by ordering from fge you confirm your agreement to these Terms and Conditions.

This site complies with appropriate UK legislation and is to be used only by persons who access it from within the UK. The services on this site are only available to UK residents.

All images on this site are reproduced with a view to portraying our products as accurately as possible. Please be aware that designs may vary slightly from those shown, due to normal design and production fluctuations.

Methods of purchasing Goods

Other ways to pay

If you do not wish to pay online you can telephone your order through to us on 020 8332 0232. The following methods of payment are accepted:

  • Credit card – see above cards that can be accepted
  • Cheque/Postal Order - Goods will be dispatched once the cheque has cleared. This may take up to 10 working days.
  • Direct Bank Deposit - Goods will be dispatched once the funds are cleared in the fge account. This can be arranged at any branch of Lloyds TSB.
  • Bank Transfer - Most UK banks will carry out bank transfers. Goods will be dispatched once the funds are cleared in the fge account.

Orders placed by those aged under 18 must have the consent of a parent or guardian. The card holder must be available to give their consent.


Buying Products on Our Website

We reserve the right to withdraw any goods or services from the website at any time. The price of any product is in force at the date and time of your order.

Whilst it is our intention to keep our website up to date and error free, pricing errors or product descriptions may occur. If we discover such an error after you have submitted an order to us, we will contact you with the correct details prior to accepting your order. You may then either cancel your order or re-confirm it based on the correct information. If we are unable to contact you, we will treat your order as cancelled.

 

Complaints Procedure

We are committed to providing a high quality service to all our customers. We aim to deal effectively and fairly with any complaints and comments to help maintain this. Complaints will be acknowledged within 5 working days and you will be kept informed of the progress of your query.

Your Right to Cancel

Under the Consumer Protection (Distance Selling) Regulations 2000, you have the right to cancel the contract for the purchase of your order within seven days of delivery (starting the day after the receipt of the goods).

To cancel this contract, you must either e-mail us at enquiries@fgecomms.com or telephone us on 020 8332 0232 (Mon-Fri 9.00am-5.30pm) within seven working days of delivery of your order, quoting your order reference number, giving the reason for the return as "Contract Cancellation".

You should be aware that, once we begin the delivery process for your order, you will not be able to cancel the order should you decide that you do not want to receive the items.

You are responsible for returning the items and they must be received by us in a re-saleable condition. The item must not have been used, must be complete with all components and the packaging must be not be damaged. Note that if these conditions are not met we may not be able to accept the returned goods.

We recommend Royal Mail First Class Recorded Delivery for returning items, or Royal Mail Special Delivery for higher value items.

We will refund the total amount of money paid by you for the goods, less any costs to deliver the goods, within 15 days, starting with the day on which we receive the goods back from you.

 

Returns Policy

In addition to your statutory rights, if you wish to return goods outside of the 7 day cancellation period, we operate a 21 day faulty returns period. Goods with faults reported outside the first 21 days after the goods arrive should be sent to the manufacturer for repair.

All of the products on sale have met our high quality-control standards. However, if you find a defect with any product purchased or the goods received are incorrect, please e-mail us at enquiries@fgecomms.com  or call us on 020 8332 0232 Monday to Friday 9am to 5.30pm.

We do not operate a try before you buy policy. However, any goods found to be defective within 21 days will be replaced. Goods found to be tampered with by the customer will not be replaced, but will be returned at the customer's expense. If you wish to return goods, we will only accept the return if the goods are in pristine condition in the original packaging and having not been used. Otherwise fge will charge the customer a fee to compensate fge for the written down value of the stock. Return shipping is at the customer’s expense. These goods can be exchanged for other products, subject to the difference in costs being incurred. Items returned for a refund when the goods are not faulty will be charged a handling fee of 15%.

If any goods are returned in an incomplete manner, fge at it’s discretion can either reject the returned item as incomplete and return the goods at the customer’s expense, or fge can charge the customer a sum equivalent to the replacement cost of the missing item – this can include small items such as manuals, cables, batteries, styli, etc. If we cannot replace the missing item (ie replacement hard copy manuals which are very difficult to replace) then we will charge the customer a fee to compensate us for the written down value of the incomplete stock.

Please note that software of any description is exempt from the Distance Selling Act, so before you open, use or register the software element of your ordered product(s), please check, where possible to do so, that goods function correctly. Where it is not possible to ascertain the functionality of the goods without loading the software, please check with fge to see if the software is available in a downloadable format. If any returned goods are not faulty, and the goods contain software that has been opened, used or registered, a 25% fee will apply to compensate us for the loss of the software element of the goods in question.

Refunds by credit card are made to the same credit card that was used for the original purchase. The above conditions are in addition to your statutory rights, which are not affected.

 

Manufacturer’s Warranty

Outside of the 21 day faulty return period, items for repair should be sent to the manufacturer for repair or replacement.

Delayed/Lost Delivery

If you have not received your order within 5 working days of despatch, you must immediately advise fge Customer Services of the delay/loss. *In the event of a free-of-charge replacement order being sent, you will need to complete a “declaration of non-delivery” of the initial order. The declaration form will be sent to the email address supplied with the initial order, and on receipt, will require completion in full and returned to the address supplied by Customer Services.

Should the completed non-delivery declaration form not be received within 10 working days of receipt, then you will become liable for the cost of the replacement goods and postage. This charge will be refunded upon receipt of the completed non-delivery declaration form if received within 21 working days of the dispatch of your replacement order. For the avoidance of doubt, replacement goods will have to be paid for at the time of the order.  Duplicate forms can be requested from fge Customer Services.

* Based upon the circumstances, and FGE’s sole discretion which is non-negotiable.

 

 Information You Provide To Us

The following applies to any information you give us, for example during any registration or ordering process.

You authorise us to use, store or otherwise process any personal information which relates to and identifies you, including but not limited to your name, email address, telephone number and address, to the extent reasonably necessary to fulfil your order, market/communicate products and services and deal with any enquiries relating to the same whether by us, our partners, successors (including the purchaser of the whole or part of our business), associates or sub-contractors (together our 'Partner Companies'). If you would like to request information or review or modify any part of your personal information then you should e-mail us at enquiries@fgecomms.com.

If you obtain or choose to buy products through our website or give us personal information then we may collect information about your buying behaviour and if you send us personal correspondence such as emails or letters then we may collect this information into a file specific to you. All such information collected by us shall be referred to in these terms and conditions as 'Personal Information'

 

Fraud

FGE Limited will not tolerate any attempts to obtain goods by fraudulent means. Any fraudulent action will be reported to the relevant authorities. Please note that Internet host IP addresses are recorded when placing an order online.

Any brand names used on our website are the trademarks of their respective owners. The use of recognised brand names on the website is for the promotion of these branded products and does not imply any affiliation or representation of the respective brand owners. Errors and omissions accepted. All rights reserved.

Please be aware that using unofficial products with your mobile phone may invalidate your phone's manufacturer's Warranty. FGE is not responsible for any damage caused to your phone.

We may alter these terms and conditions from time to time and post the new version on our website, following which all use of our website will be governed by that version. You must check the terms and conditions on the website regularly.
